(Clearwisdom.net) Mr. Shen Yang is a Falun Gong practitioner from Huaian City, Jiangsu Province. On July 11, 2009, Xie Jianning, Middle Court judge of Huaian City, informed Mr. Shen that he was required to attend a court hearing that afternoon, otherwise lose his right to appeal. Mr. Shen was temporarily released so that he could attend the court proceedings. At the required time and place, Xie Jianning refused to appear, then made a false counter-charge, claiming that Mr. Shen did not keep his promise to attend.
Summary of Mr. Shen's Appeal:
On March 22, 2009, Mr. Shen Yang was arrested by several policemen from Mianhua Village as he was walking on a street, then held in the Huaian City Detention Center. Police officials extorted 2,000 yuan from Mr. Shen Yang's family, then temporarily released Mr. Shen for a pending trial. On May 18, Mr. Shen was illegally sentenced to three years of imprisonment by the Huaiyin District Court. Mr. Shen was subsequently ordered to attend a court hearing. On June 17, Mr. Shen and his mother attended the court hearing and asked for a written judgment. Court officials refused, then sent Mr. Shen to the Huaian City Detention Center. Detention center officials refused to accept Mr. Shen, so the court policemen temporarily released him until his pending trial date.
On June 26, Mr. Shen lodged an appeal with the Middle Court of Huaian City. In the appeal statement, Mr. Shen explained how wonderful Falun Dafa is, the grand event which Dafa is spreading worldwide, and that those who treat Dafa well will receive benefits as repayment and about the opposite retribution. Meanwhile, Mr. Shen explained that he lodged his appeal because according to the current law, neither the procurator's indictment nor the Huaiyin District Court verdict clearly defined the criminal offense charges. Therefore, the indictment and verdict against Mr. Shen was be untenable.
On July 11, 2009, Xie Jianning, judge of Criminal Court 2, Middle Court of Huaian City, ordered Mr. Shen Yang by phone to attend an afternoon court session with him, and threatened Mr. Shen, saying that if he didn't attend the hearing, it would lose his right to appeal. That afternoon, Mr. Shen went to the Middle Court as required, but the guard did not let him enter. The guard indicated that Judge Xie Jianning was busy in court and did not have time to receive him. Mr. Shen and family waited until 6:00 p.m. Mr. Shen then asked the guard to call Judge Xie, to find out why he did not meet with him. Xie Jianning lied on the phone, "I have sent staff to the front door twice to look for you, but you were not there." Mr. Shen Yang immediately exposed the lie by saying, "I've been waiting at the front door for you from 3:00 p.m. to 6:00 p.m. Your entrance guard said that you were busy and did not have time for me."
Additionally, the World Organization to Investigate the Persecution of Falun Gong (WOIPFG) has issued an investigation announcement concerning this case against the Chinese Communist Party (CCP) Political and Judiciary Committee, Court, Procurator and judicial officer Guo Zhenxiang of Huaiyin District.
Judge Xie had previously sentenced practitioners Ms. Lin Fengying and Mr. Liu Zhigao.
