Requests:

To bring all units and individuals involved in the persecution of Falun Gong practitioners to justice; to restore Teacher Li Hongzhi's good name; to restore Falun Gong's blameless reputation; to release all detained Falun Gong practitioners; and to return justice to the world!

We request that all our legitimate rights and interests be safeguarded and the peaceful practice environment be reinstated. We also request compensation for all our financial and mental losses according to Articles 26 and 27 in the Compensation Law of the People's Republic of China (PRC).

The lawsuit is based on the following legal grounds: At the beginning of December 2003, Mayor Yang Xing personally directed personnel from the Qiqihar City 610 Office, the Qiqihar City Police Department, the Longsha District Police Department, the Wulong Police Station, and the Anshun Road Police Station to illegally arrest many local Falun Gong practitioners.

On December 9, 2003, practitioner Zhang Dexiang was arrested as he was distributing Falun Dafa truth material, and a confession was exhorted from him by torture. Soon afterwards, more than 20 other practitioners were arrested.

In the afternoon on December 9, 2003, Sun Bo, Deputy Director of the Longsha District Police Department, and Wang Xishun, Director of the Longsha District Wulong Police Station, knocked on practitioners' homes intending to ransack the residences. After being refused entry, they called in fire engines and an anti-riot squad to break down the practitioners' doors with power equipment. They rushed in and illegally ransacked the homes. In two hours, they looted equipment including computers worth 22,000 yuan. Wang Xishun seized the chance to rob practitioners Niu Fengqin and Cheng Yulan of 1600 yuan. They even plundered ladles and a bag of rice.

While they were confined, 34-year-old Ms. Hua Xiaojuan was tortured by the police with the "Big Hang Up" (1) and her nails were burned with cigarette butts in the Longsha District Anshun Road Police Station; 70-year-old Qi Yuzhen was beaten by the police and thrown to the ground in the Longsha District Anshun Road Police Station; 57-year-old Ms. Wang Shujuan was also tortured on the "Big Hang Up," with handcuffs placed on her bloodstain hands; 64-year-old Zhang Xiuying was tortured on the "Big Hang Up" twice; Zhang Dexiang was tortured on the "Big Hang Up" in addition to other means of torture in the Longsha District Wulong Police Station.

On April 8, 2004, the Qiqihar City Police Department issued arrest warrants for practitioners Hua Xiaojuan, Niu Fengqin, Lang Jieli, Wang Shujuan, Zhang Dexiang, Shi Xiuying, Zhang Yuqin, Zhong Yajun, Zhang Shujing, and Sun Shulan.

On August 11, 2004, these practitioners were given the following sentences: Hua Xiaojuan, 10 years; Zhang Dexiang, 10 years; Niu Fengqin, eight years; Zhong Yajun, seven years; Shi Xiuying, seven years; Zhang Yuqin, six years; Lang Lijie, five years; and Wang Zizhong, four years.

In 2002, practitioners arrested and sentenced included Jiang Yuan, three years; Dong Yanqiu, two years; and Li Hongmin, three years.

The lawsuit cites the following legal grounds: the Mayor of Qiqihar City Yang Ying; the Qiqihar City 610 Office (Political and Judiciary Committee); the Longsha District Procuratorate in Qiqihar City; the Longsha District Court in Qiqihar City; and the Qiqihar City Police Department have violated the following articles of the Constitution: Article 36 "Citizens of the People's Republic of China enjoy freedom of religious belief;" Article 35 "Citizens of the People's Republic of China enjoy freedom of speech, of the press, of assembly, of association, of procession and of demonstration;" Article 37 "Freedom of the citizens of the People's Republic of China is inviolable" and "the illegal detention and illegal deprivation of limiting the citizen's personal freedom are prohibited;" and Article 19 "Everyone shall have the right to hold opinions without interference; Everyone shall have the right to freedom of expression; this right shall include freedom to seek, receive and impart information and ideas of all kinds, regardless of frontiers, either orally, in writing or in print, in the form of art, or through any other media of his choice."

Yang Xing and the law enforcement departments and individuals have committed the following crimes: depriving citizens of their' freedom of religious belief, the abuse of power, distorting the law to suit their personal purpose, and the illegal detention of Falun Gong practitioners.

Deputy Director of the Longsha District Police Department Sun Bo and Director of the Longsha District Wulong Police Station Wang Xishun broke into practitioners' residences to ransack and loot their belongings worth 22,000 yuan. Wang Xishun robbed practitioners of more than 1,000 yuan.

The above acts violate Article 39 of the PRC's Constitution and Article 245 of the PRC's Criminal Law, which state that subjecting another person to a body search and intrusion of his residence are prohibited.

The Longsha District Wulong Police Station; Director of the Longsha District Wulong Police Station Wang Xishun; the Longsha District Anshun Road Police Station; Director of the Longsha District Anshun Road Police Station Chen Hongli; Deputy Director of the Qiqihar City No. 1 Detention Center Guo Zhengchuan; and police officers Rong Wei, Xu Haiying, Fang Zhengwei, Peng Li, Ren Yuxia, and Hao Jinhua have, by their torture of practitioners, violated Article 5 of the Universal Declaration of Human Rights, which states "No one shall be subjected to torture or to cruel, inhuman or degrading treatment or punishment," and have violated Article 248 of the PRC's Criminal Law by abusing detainees.

Considering the illegal acts of Qiqihar City Mayor Yang Xing; the Qiqihar City 610 Office (Political and Judiciary Committee); the Longsha District Procuratorate in Qiqihar City; the Longsha District Court in Qiqihar City; the Qiqihar City Police Department; Deputy Director of theLongsha District Police Department Sun Bo; the Longsha District Wulong Police Station and its director Wang Xishun; theLongsha District Anshun Road Police Station and its director Chen Hongli; the Qiqihar City No. 1 Detention Center and its deputy director Guo Zhengchuan; and the police officers of the Qiqihar City No. 1 Detention Center Rong Wei, Xu Haiying, Fang Zhengwei, Peng Li, Ren Yuxia, Hao Jinhua, we request their punishment according to the Constitution and Criminal Law Code, and we request compensation according to the Compensation Law of the People's Republic of China and the Universal Declaration of Human Rights.

Note:

1) Big Hang Up - There are two forms in this torture: a) With both hands cuffed behind the back and only toes touching the ground, one is hung by a rope that is tied to the metal window frames or b) One hand of a practitioner is cuffed to one bunk bed and the other hand to another bed, and the two beds are pulled in the opposite directions. One feels extremely painful as the body is pulled.
