Fuzhou City Judicial, Prosecutorial, and Public Security Departments Violate the Rights of Falun Gong Practitioners and Their Lawyers

(Clearwisdom.net) In recent years, many lawyers have dared to speak the truth and defend Falun Gong practitioners and uphold justice. However, the CCP's judicial, prosecutorial, and public security departments in Fuzhou City are using different means to prevent the lawyers from exercising their legal rights.

The followings are brief descriptions of some typical cases.

I. Police officer unavailable, lawyer unable to meet with his client

Falun Gong practitioner Mr. Zuo Fusheng worked in the Fuzhou Railway Bureau. On the morning of January 19, 2011, he was arrested by a group of people whose identities remain unknown. They seized his cash, bank cards, shopping cards, keys, and other items that he carried with him. They opened the door to his home with the key and lied to his nearly 80-year-old grandmother that they were his co-workers. Then they ransacked the home, took valuables, such as computers, and left a notice of criminal detention signed by the Cangshan District Public Security Bureau.

On February 14, Mr. Zuo's lawyer went to Fuzhou City's First Detention Center to meet with him. However, the detention center said that, in order for them to meet, the case handler had to agree and be present at the meeting. Upon inquiry, the case handler was found to be Lin Feng of the State Security office.

The lawyer called the office, but the person who answered the phone said he did not know Lin Feng. Later, the family found Lin Feng's cell phone number and called him on February 16. A person answered the phone but adamantly denied that he was Lin Feng and said that he did not know who was handling Mr. Zuo's case. The family asked, “Why won't you let Mr. Zuo's lawyer meet with him? According to the law, the only cases where lawyers cannot meet the clients are confidential ones. What is the reason here to not let the lawyer meet with his client?” The person just kept saying “Not sure” and “Do not know” and hurriedly turned off the phone.

II. Making excuses to deny a lawyer-client meeting, then secretly sending the client to a forced labor camp

Also on January 19, 2011, Falun Gong practitioner Ms. Chen Xue of the Fujian Academy of Engineering was arrested by the Station Security office of Fuzhou Public Security Bureau while on her way to work. They ransacked her home and took away computers, Falun Gong books, and other personal belongings. They left a detention card from the Cangshan Branch of the Public Security Bureau.

On February 16, her lawyer called Lin Feng and asked to meet with Ms. Chen. Lin Feng replied that he had to ask his manager. Later Lin Feng called the lawyer and said the manager did not agree and said they would notify the lawyer to meet with Ms. Chen after the prosecution phase.

On February 25, Ms. Chen was secretly sent to Fuzhou Women's Forced Labor Camp for two years.

III. Forcing a lawyer's termination

Falun Gong practitioner Ms. Ye Qiaoming was a staff member at Fujian Normal University. On September 16, 2009, she was arrested by state security police and detained for one year in Fuzhou Second Detention Center. During that time, her son hired a lawyer from Beijing. The lawyer questioned the “evidence” provided by the state security personnel, and the originally scheduled March 4 hearing was hastily canceled. Soon after, the judges and the state security police pressured Ms. Ye's son through her relatives, and he lived in constant fear. Then they arrested him and took him to the City Public Security Bureau. Ms. Ye's son was just a young child, and with the stress and fear, against his will he signed a paper that terminated the contract with the lawyer. Then they threatened Ms. Ye that they would harm her son if she did not terminate the lawyer. On April 9, they hastily brought her case to trial, and there was no lawyer to defend her. On September 15, the Cangshan Court sentenced her to three years in prison with four years probation.

IV. Not notifying the lawyer or family about the hearing, not letting the lawyer defend his client

Falun Gong practitioner Ms. Zhang Liyu lives in the Shangdu area in the Cangshan District of Fuzhou City. On the morning of April 5, 2010, Ms. Zhang was in her hometown of Baiyun Village, Yongtai County, clarifying the truth to some students. She was arrested by Baiyun police and held at the Yongtai County Detention Center. On the afternoon of April 6, more than a dozen people from Fuzhou City State Security, Yongtai County Public Security, and the Baiyun Village Police Station, as well as the local street committee, went to ransack Ms. Zhang's home. On April 21, she was once again arrested. Her family hired a lawyer from Beijing, but the Yongtai County Court tried various ways to have the lawyer removed. They even tried to force Ms. Zhang to sign to remove him but were unsuccessful. On the morning of September 17, Yongtai County Court tried Ms. Zhang, but they violated the law and did not notify her lawyer or Ms. Zhang's family. Ms. Zhang was sentenced to three years in jail with four years probation.

V. Lawyer not allowed to see prosecution statement or meet with his client

Falun Gong practitioner Mr. Wang Yongjin was arrested on August 31, 2010, and was held in the Fuzhou City First Detention Center. His family hired a lawyer from Beijing to defend him. State Security police called the family and threatened them, asking why they had hired a lawyer, why they hired a lawyer from Beijing, and said that hiring a lawyer would do no good in Mr. Wang's case. Mr. Wang's family was unmoved and insisted on exercising their rights. However, the State Security police and the 610 Office mobilized all their people to keep the lawyer from getting involved. They would not allow the lawyer to meet with his client or read the case files.

Mr. Wang's lawyer has filed a lawsuit against six officials, including Fuzhou Public Security Bureau Wang Xin and Fuzhou City Procuratorate director Chen Chengping with the Fujian Provincial Procuratorate. Whether or not the Provincial Procuratorate will accept the lawsuit, this case will become important evidence for current international legal trials and for the future historical record.

Conclusion

China's public security, prosecutorial, and judicial departments completely ignore the “law” when persecuting Falun Gong practitioners. The presence of lawyers and how they have been dealt with by the authorities shows how the CCP manipulates the law to persecute good people. These lawyers again and again have maintained that Falun Gong practitioners are innocent and that it is not illegal to have a belief or to tell people about the persecution. When clarifying the truth, Falun Gong practitioners do not violate any of the laws that the CCP itself has made. Because of this, in the Falun Gong cases around the country, the CCP has adopted a variety of coercive means to prevent lawyers from getting involved. Fuzhou Falun Gong practitioners' rights, as well as those of their families, have been arbitrarily taken away by the judicial, prosecutorial, and public security departments, which are controlled by the 610 Office.
