(Minghui.org) Mr. Qin Wei lives in the Bayi Middle School dormitory in Haidian District of Beijing. He was formerly an art teacher at Bayi Middle School. Because he was a Falun Gong practitioner the neighborhood committee and the Haidian District Police Station collaborated to monitor his daily activities. The police arrested him for the sixth time on November 26, 2012, using the excuse of “maintaining social stability” for the 18th National People's Congress. He was later sentenced to two-and-a-half-years of forced labor.
Mr. Qin Wei graduated from the Department of Decorative Painting at the Central Academy of Fine Arts. He is an honest and kind person who is always willing to help others. After he began practicing Falun Gong, he was able to let go of his attachment to fame and personal gain and properly resolve family conflicts. His students, coworkers, and friends all enjoyed being around him. During the 13 years of the Chinese Communist Party's (CCP) persecution of Falun Gong, Mr. Qin has been arrested multiple times. In 2000, he was sentenced to one-and-a-half-years of forced labor at Tuanhe Forced Labor Camp in Beijing, and was subjected to savage beatings and shocking with electric batons. He was sentenced to five years in prison at Qianjin Prison in Beijing in 2004. There, he was physically abused, forced to undergo brainwashing, and held in solitary confinement. He was later transferred to the Chadian Prison of Beijing, where the torture continued. When he was released, his workplace fired him. He could then barely make a living by teaching kids how to paint.
Mr. Qin's wife desperately wanted to live a peaceful life. However, as a result of the 18th National People's Congress, her husband was arrested again. On November 26, 2012, two students were waiting for Mr. Qin to start his class. His family didn't know where he was and only noticed some cigarette butts on the floor of his room (Mr. Qin had stopped smoking after beginning to practice Falun Gong). A week later, the Haidian District Police Station notified his wife of his arrest and told her to go to the police station. She was only told, “Your husband has been arrested,” and no further details were provided.
Mr. Qin's arrest and the illegal home search, as well as the restriction of personal freedom, violate Title 5 of Article 22 of the Law of Policing, which explicitly prohibits “illegal deprivation or restriction of personal freedom, unlawful search of another person's body, articles, residence, or property.” His arrest also violated the Criminal Law and constituted the crime of illegal detention. Article 9 of the Law of Policing specifies, “For continued interrogation of the suspect, the police shall immediately notify the suspect's family and workplace.” In violation of the law, the Haidian District Police Station did not notify Mr. Qin's family after 24 hours of detention, as required. They also violated Article 64 of the Criminal Litigation Law, which states, “At the time of arrest or detention, the police shall produce an arrest or detention warrant. Unless it interferes with the investigation or circumstances that make notifying the family impossible, the police shall, within 24 hours of the arrest or detention, inform the family or the workplace of the arrested or detained of the reason and place of detention.”
Mr. Qin's 78-year-old mother suffers from heart disease and relies on him to take her to the doctor. She is now left unattended. Mr. Qin's wife is very busy with work and is now under tremendous stress.
