(Minghui.org) A hearing of Mr. Luan Changhui’s motion to reconsider his four-year prison sentence for practicing Falun Gong was held on December 19, 2022.
Falun Gong, also known as Falun Dafa, is a spiritual discipline that has been persecuted by the Chinese communist regime since 1999.
Mr. Luan Changhui, a 51-year-old boat engineer in Huludao City, Liaoning Province, was arrested on July 20, 2021, while working at the Bohai Shipyard. Wang Fubiao of the Longgang District {Procuratorate}} approved his arrest on August 3 and later moved the case to the Lianshan District Procuratorate. Prosecutor Long Dan indicted him on September 24, 2021.
When Mr. Luan appeared in the Lianshan District Court on November 24, 2021, his lawyer argued that the prosecutor failed to provide evidence to show how he “undermined law enforcement with a cult organization,” the standard pretext used to criminalize Falun Gong in China. The lawyer added that no law has ever criminalized Falun Gong in China and that the Chinese Publication Bureau lifted the ban on Falun Gong books in 2011.
Mr. Luan’s lawyer and his wife, who acted as his family defender, requested to see the Falun Gong items confiscated from him presented in court. But judge Li Fushan rejected them and sentenced Mr. Luan to four years with a 20,000-yuan fine six days later.
Mr. Luan appealed with the Huludao City Intermediate Court, which ruled to uphold his original sentence on January 25, 2022, without holding a hearing. His family soon filed a motion to reconsider his case with the intermediate court, which assigned it a docket number on April 25, 2022.
To seek justice for Mr. Luan, his mother, Ms. Zhong Shulian, also filed complaints against those involved in his case, including Sun Yuzhu (head of Bianfang Police Station), Wang Fubiao (prosecutor of Longgang District Procuratorate), Long Dan (prosecutor of Lianshan District Procuratorate), Li Fushan (judge of Lianshan District Court), as well as Yin Miao, Han Ling and Xue Chunlai, all of whom are judges of the Hululdao City Intermediate Court.
As a result of her complaint, prosecutor Long is no longer involved in Falun Gong cases and judge Li has been moved to the enforcement department of the court.
On December 19, 2022, four months after Mr. Luan was taken to the Shenyang No.1 Prison, the intermediate court held a hearing of his motion.
In the one-hour-long hearing, Mr. Luan’s lawyer emphasized again that Falun Gong has never been outlawed or labeled as a cult in China. The lawyer also showed judge Yu Yang a documentary that analyzed the suspicious points of the “Tiananmen self-immolation” hoax staged by the communist regime to demonize Falun Gong. The judge said he would find time to finish watching it after the hearing.
When Mr. Luan’s lawyer was making a defense argument for him, the judge listened quietly most of the time and he only stopped the lawyer when he talked about the international lawsuits against Jiang Zemin, the former head of the communist regime who ordered the persecution, and the comparison between the persecution of Falun Gong and the cultural revolution (1966-1976).
The judge has yet to make a decision on Mr. Luan’s motion case.
